Debt recovery lawyer in L'Océan
Debt recovery: the firm assists residents and companies of L'Océan, from the first consultation to enforcement.
The firm helps companies and individuals recover the sums owed to them: unpaid invoices, private loans, bounced cheques or rent. We first seek an amicable recovery, then bring the appropriate court proceedings, such as an order for payment, up to the seizure of the debtor's assets.
- Enforcement of judgments with the judicial officer
- Recovery of rent and of debts between individuals
- Analysis of the debt and the evidence: invoices, contracts, cheques, bills of exchange
- Formal notice and negotiation of a payment plan
- Order for payment procedure before the court of first instance or the commercial court
Competent courts
For a matter concerning a resident of L'Océan, the following courts normally have jurisdiction:
- Court of First Instance of Rabat (including its Family Justice Section)
- Commercial Court of Rabat
- Court of Appeal of Rabat
Matters we handle there
As an older, family district, L'Océan mainly sees inheritance cases, joint ownership, division of family houses and long-standing leases. Renovation and sale of buildings also raise land title and co-ownership questions. Family matters (divorce, maintenance, custody) and small commercial disputes complete the picture.
How a matter unfolds
- 1
Checking the debt
We check that the debt is certain, quantified and due, that the evidence is sufficient and that it is not time-barred.
- 2
Amicable stage
We send a formal notice on the firm's letterhead and, where possible, negotiate payment or a written payment plan.
- 3
Court proceedings
Depending on the case, we apply for an order for payment, bring a full claim or file a complaint for a bounced cheque, with a protective seizure if needed.
- 4
Enforcement
We follow enforcement with the judicial officer: seizure of accounts, assets or wages, until payment is actually made.
Frequently asked questions
What can you do with a bounced cheque?
The payee first has the bank certify the lack of funds (certificate of refusal to pay or protest). The payee can then bring a civil claim for payment and file a complaint, as issuing a cheque without sufficient funds is an offence under the Commercial Code (Law No. 15-95). Getting paid remains the priority, and the strategy is decided case by case.
When does a debt become time-barred?
The general limitation period in civil matters is fifteen years (Article 387 of the Code of Obligations and Contracts), but many debts have shorter periods. Obligations arising from trade, between traders or between traders and non-traders, are time-barred after five years unless a special provision applies (Article 5 of the Commercial Code), and bills of exchange and cheques have their own periods. It is therefore important to have the limitation period checked before any proceedings.
