Divorce and family law

The firm assists and represents spouses and parents in the proceedings provided for by the Family Code (Law No. 70-03): divorce, maintenance, child custody and visiting rights. Every case is handled with discretion, looking first for an amicable solution where possible, and firmly defending your rights before the family division of the court of first instance.

What the firm does

  • Divorce for discord (chiqaq): petition, reconciliation hearings and defence of your rights
  • Divorce by mutual consent: drafting the agreement and filing it with the court
  • The wife's rights after divorce: consolation gift (mut'a), maintenance during the waiting period, deferred dowry (sadaq)
  • Maintenance (nafaqa) for children and spouse, applications for review
  • Child custody (hadana), visiting rights and the child's housing
  • Enforcement of judgments and action when maintenance is not paid
  • Marriage, recognition of marriage and parentage
  • Domestic violence: complaints and protective measures (Law No. 103-13)

You live abroad and need to divorce, or have a divorce recognised, in Morocco.

How a matter unfolds

  1. 1

    First meeting

We listen to your situation, review the marriage certificate and other useful documents, and explain the options available: agreement or contested proceedings.

  2. 2

    Strategy and documents

We choose the appropriate procedure (mutual consent, chiqaq or another route), assess the rights at stake and prepare the petition with evidence of income and expenses.

  3. 3

    Reconciliation and hearings

We attend the mandatory reconciliation attempts with you and argue your claims on custody, maintenance and financial rights.

  4. 4

    Judgment and enforcement

After the judgment, we follow its service and enforcement and, where needed, lodge an appeal or take action against a debtor who does not pay.

Frequently asked questions

How long does a divorce for discord (chiqaq) take in Morocco?

Article 97 of the Family Code provides that the court must rule on a petition for divorce for discord within a period not exceeding six months from the date it is filed. In practice, the length also depends on summonses, reconciliation attempts and the parties' attendance at hearings. This period applies at first instance: an appeal can extend the proceedings.

What documents are needed for a divorce petition?

Generally: a copy of the marriage certificate, the national identity card, the children's birth certificates and evidence of both spouses' financial situation (salary, rent, expenses). Depending on the case, other documents may help, for example about the marital home or the causes of the discord. We give you a precise list at the first meeting.

What are the wife's rights in a divorce by mutual consent?

In a divorce by mutual consent (Article 114 of the Family Code), the spouses set the terms of the separation themselves, including the wife's financial rights, provided these terms do not conflict with the Code or with the children's interests. The court attempts reconciliation and, if it finds that the agreement stands, authorises the divorce deed to be drawn up. It is therefore important to have the agreement reviewed before signing it, as it binds both parties.

Who gets custody of the children and how is maintenance set?

Under Article 171 of the Family Code, custody goes first to the mother, then to the father, then to the maternal grandmother, although the court may decide otherwise in the child's interest. Once the child turns fifteen, they may choose which parent will have custody (Article 166). Maintenance is set taking into account the income of the person who owes it, the child's situation and the cost of living (Article 189).
