Frequently asked questions

How do you have a divorce granted in France recognised in Morocco?

A foreign divorce judgment must be granted exequatur to take effect in Morocco. Article 128 of the Family Code provides that divorce judgments issued by foreign courts are enforceable if they come from a competent court and are based on grounds that are not incompatible with those provided for by the Code. The application is filed with the competent court of first instance with a copy of the judgment, proof that it is final and their Arabic translation.

Do you need to travel to Morocco for the proceedings?

In many cases, no: the lawyer can represent the client before the court on the basis of the documents and, where necessary, a power of attorney. Some procedures do, however, require the parties to attend in person, for example reconciliation attempts in a divorce. We tell you from the outset which steps require your presence.

How do you register in Morocco a marriage celebrated abroad?

Article 14 of the Family Code allows Moroccans living abroad to marry according to local administrative formalities, provided the substantive conditions of the Code are met, in particular the presence of two Muslim witnesses. Article 15 then requires a copy of the marriage certificate to be filed, within three months, with the Moroccan consular services or, failing that, with the Ministry of Justice. If difficulties arise, an action for recognition of the marriage may be considered.

How can you manage an estate or a property in Morocco from abroad?

You can give a power of attorney to a trusted person or instruct a lawyer for court proceedings. The firm can check the status of the property at the land registry, coordinate the drawing up of the certificate of inheritance and take action against an unlawful occupant. Each step is reported to you in writing so that you keep a clear record of the case.
