- Court of Cassation (seated in Rabat)
Matters we handle there
A city of civil servants, professionals, traders and families, Rabat produces a wide range of cases: divorce, maintenance and child custody, tenancy disputes, property transactions and inheritance. Its business community and liberal professions raise questions of contracts, debt recovery and company law. With central government based here, claims before the Administrative Court are also common, particularly on civil service careers and expropriation.
How a matter unfolds
- 1
Legal audit
We examine the land title or deeds, the contract and the correspondence to identify your rights and the risks.
- 2
Advice or formal notice
Depending on the case, we secure the deed before signing or send a formal notice to the other party to seek a settlement.
- 3
Proceedings
If no agreement is reached, we bring the matter before the competent court, request a court-ordered survey or protective measures where needed, and argue your case.
- 4
Enforcement and registration
We follow the enforcement of the judgment and, where applicable, its registration at the land registry.
Frequently asked questions
Do you need a lawyer to buy property in Morocco?
Article 4 of Law No. 39-08 on the Real Rights Code requires, on pain of nullity, that deeds transferring ownership be drawn up as an authentic deed (by a notary or adouls) or as a deed with a certain date drafted by a lawyer admitted before the Court of Cassation. Even where a notary drafts the deed, a lawyer can advise you beforehand, check the land title and negotiate the terms of the preliminary agreement.
How do you evict a tenant who does not pay rent?
For a residential lease governed by Law No. 67-12, the landlord first sends a formal notice to pay, and may then go to court to obtain payment of the rent, termination of the lease and eviction. The exact procedure depends on the contract and the situation. Eviction can only be carried out under a court decision, by a judicial officer: taking the law into your own hands is prohibited.
