Matters we handle there
Aïn Aouda's mix of suburban and rural character raises land questions: family land, unregistered property, applications for land registration, division between heirs and sometimes expropriation. New housing estates raise questions about property purchases and compliance. Family matters and road traffic accidents are also common.
How a matter unfolds
- 1
Legal audit
We examine the land title or deeds, the contract and the correspondence to identify your rights and the risks.
- 2
Advice or formal notice
Depending on the case, we secure the deed before signing or send a formal notice to the other party to seek a settlement.
- 3
Proceedings
If no agreement is reached, we bring the matter before the competent court, request a court-ordered survey or protective measures where needed, and argue your case.
- 4
Enforcement and registration
We follow the enforcement of the judgment and, where applicable, its registration at the land registry.
Frequently asked questions
What can you do if a flat bought off-plan is delivered late?
Off-plan sales are governed by Law No. 107-12, which requires a written contract specifying, among other things, the delivery date and the guarantees. In the event of delay, the buyer may, depending on the contract and the law, seek performance, compensation for the delay or cancellation of the sale with a refund of the sums paid. Gather the contract, payment receipts and correspondence with the developer before taking action.
What is the difference between a registered property and an unregistered one (melkia)?
A registered property has a land title held by the land registry: the rights entered on it are enforceable against everyone and the title is final and cannot be challenged (dahir of 12 August 1913 as amended by Law No. 14-07). An unregistered property relies on deeds, often drawn up by adouls such as the melkia, whose value can be disputed. Before buying an unregistered property, it is wise to have the deeds checked and to consider applying for registration.
